Judge Rules: Pitts v. DHH Can Proceed

On May 18, 2011, AC received a positive decision in Pitts v. Department of Health and Hospitals (DHH), which seeks to prevent hundreds of low-income people with severe disabilities from losing services and being institutionalized in nursing facilities. The judge ruled that the suit can proceed to trial, dismissing DHH’s motion for summary judgment.

Restraint and Seclusion in Schools

The Advocacy Center is interested in information on the use of restraint or seclusion in Louisiana schools. We suspect that numerous students with disabilities across Louisiana are being subjected to some form of restraint or seclusion to deal with noncompliant behavior, though we do not seem to get many reports.

A very important ADA case is about to be argued in the U.S. Court of Appeals for the Fifth Circuit in New Orleans on May 24, 2011. Because of its importance for all people with disabilities in Louisiana, and especially those with mobility impairments, we encourage all interested individuals to attend the argument.
